PRIVACY POLICY

Last updated: July 17, 2026

Sticky Marketing Agency LLC (“Company,” “we,” “our,” or “us”) values your privacy. This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use our website, funnel pages, digital products, mobile applications, hosting infrastructure, and agency services (collectively, the “Services”). Please read this policy carefully.

1. Important Structural Distinctions: Controller vs. Processor

To understand your privacy rights, it is necessary to distinguish between the two operational data layers we manage:

The Company as a Data Controller: We act as a Data Controller for the business information we collect directly from you (our client) to manage your account, process recurring service billing, provide technical support, and execute marketing activities.

The Company as a Data Processor (Your Customers' Data): When you utilize our white-labeled SaaS platform, hosting services, workflows, and sub-accounts powered by GoHighLevel (GHL) to interact with your own customers, non-profit members, or church congregations, you are the Data Controller of that data. The Company acts strictly as a Data Processor. We host, transmit, and process your end-user data (including imported contact lists, SMS histories, form submissions, and database structures) solely on your behalf and in accordance with your system configurations.

2. Information We Collect

We collect several types of information from and about users of our Services, including:

A. Personal & Account Information

Identity & Contact Data: First name, last name, business name, professional email address, physical billing address, and phone number.

Financial & Billing Data: Credit card details, bank account information for ACH processing, transaction history, and software wallet auto-top-up thresholds. Financial transactions are securely handled directly by our integrated third-party payment processors (such as Stripe).

B. Technical, App, & Usage Data

System Log & Connection Data: Internet Protocol (IP) address, login frequency, browser type and version, time zone setting, operating system, and platform metrics.

Mobile Application Data: When accessing our platform through our companion Mobile Application, we may collect mobile device identifiers, push notification tokens, and application crash logs. Depending on your explicit device permission settings, the mobile app may require access to your device's camera (for uploading profile media or review assets) or your device contacts (for manual record imports into your sub-account).

Interaction Data: Information regarding how you use our platform, including clicks, workflow configurations, custom AI Conversational Agent interaction histories, and data gathered natively via the platform's Prospecting tool.

3. How We Use Your Information

We use the information we collect for the following core business purposes:

Service Delivery & Platform Hosting: To set up your software sub-account, provision hosting environments, execute the 30-Day Jumpstart program, maintain core platform infrastructure, and provide administrative access.

Billing & Account Management: To execute automated billing for monthly recurring service fees, annual licenses, system usage rebilling, and software wallet auto-top-ups.

Technical Support Escalation: To diagnose technical system issues, process functional help tickets, and coordinate resolution pathways with GoHighLevel's 24/7/365 live engineering and infrastructure support support channels.

Communication & Operational Alerts: To transmit necessary transactional messages, including digital product invoices, subscription renewal reminders, system uptime notices, and platform policy changes.

Marketing & Engagement: To share company updates, promotional offerings, educational tutorials, and agency insights.

4. Marketing Communications & Spam/Telecom Compliance

By providing your phone number and email address to the Company, you grant your explicit consent to receive operational, transactional, and promotional communications (including emails, automated SMS/text message responses, and voice calls) from us.

Opt-Out Mechanics: You may opt out of marketing communications at any absolute time. For emails, click the "Unsubscribe" link located at the bottom of the message. For text messages, reply "STOP" to any inbound SMS.

SMS Disclosures: Message and data rates may apply for text messaging. Your opt-out request will be processed immediately in accordance with relevant international telecommunications guidelines.

Zero-Tolerance Abuse Policy: Because our SaaS platforms rely on integrated telecom networks (including Mailgun and Twilio framework settings), we strictly prohibit the use of our services or Prospecting tools for sending unsolicited commercial spam. You must ensure that all contact lists you import or communicate with have given legally sufficient consent in strict alignment with global telecommunications regulations.

5. Sharing & Disclosing Your Information

We do not sell, rent, or trade your personal information to third parties for marketing purposes.

We disclose data only to trusted entities under the following safe parameters:

Essential Third-Party Infrastructure Providers: We share data with core technology business partners that make our Services possible. This includes our backend software provider (GoHighLevel), telecommunications gateways (Twilio, Mailgun), payment engines (Stripe), and advertising analytics networks (Meta Ads, Google). These systems process your data under strict data transmission protocols.

Legal Compliance & Safety: We may disclose your information if required to do so by local, national, or international laws, or in response to valid legal requests, subpoenas, or regulatory enforcement actions.

Business Asset Transfers: In the event that the Company undergoes a corporate restructure, acquisition, merger, or asset sale, your user data may be transferred as an active business asset to the surviving entity.

6. Cookies, Pixels, & Performance Tracking

We utilize standard web cookies, tracking pixels, and data tags to enhance user experience, personalize interface features, track active user sessions, and measure the performance of our agency marketing funnels.

You maintain the right to adjust your web browser settings to block or refuse cookies entirely. However, please note that disabling tracking cookies may cause certain interactive software tools, sub-account layouts, or client login spaces on our platform to experience functional errors.

7. Data Security & Storage Limitations

We implement industry-standard administrative, physical, and technical security safeguards designed to protect the integrity of your personal information and stored databases.

However, you explicitly acknowledge that no system of digital transmission over the internet, and no framework of electronic storage, can be guaranteed as 100% secure. While we leverage GoHighLevel's enterprise-grade infrastructure networks to safeguard your environment, the Company cannot warrant or guarantee the absolute security of your data. You remain entirely responsible for enforcing strict password security and access control parameters within your localized user accounts.

8. Children’s Privacy Mandate

Our digital platforms, SaaS software licenses, and creative agency offerings are structured exclusively for commercial business enterprises, churches, and non-profit entities. Our Services are not intended for, directed to, or structured for individuals under the age of 18. We do not knowingly target or collect personal identifying information from minors.

9. Wyoming Governing Law & Cross-Border Data Flows

The Company operates under the state jurisdiction of Wyoming, United States. Information collected via our Services may be stored, transferred, and processed within the United States or any other nation where our core technical infrastructure partners operate server facilities. By accessing our platform, you explicitly consent to the cross-border transmission of your account data. Any disputes regarding this privacy policy are subject to the exclusive venue and jurisdiction constraints outlined in our Terms of Service.

10. Changes to This Privacy Policy

The Company reserves the sole right to update, modify, or rewrite this Privacy Policy at any time to reflect software features, regulatory changes, or shifting telecom mandates. When updates are published, we will modify the "Last Updated" date located at the top of this document. Your continued use of our web funnels, software licenses, or agency configurations after an update is posted constitutes your explicit acceptance of the updated privacy framework.
